Carmona not really Carmona?
Fausto Carmona has been using an assumed name, is really 31 instead of 28 and likely wont be able to obtain a visa to pitch in America by Opening Day...allegely...

Best hamburger I ever ate was in Canada
at a place called Wimpy Burger (“I would gladly pay you on Tuesday for a hamburger today”). It’s not far from Niagara Falls. I think the town is called Tonawanda?

It actually might help Cleveland
Carmona is not that good, and it suddenly frees up an extra $7 million that they can spend on some of the bargains left on the free agent market. (This is turning into a good week for Carlos Pena.)
will that actually free it up?
i dont think the marlins got out of the contract with nunez

So how did the Nunez situation play out then?
I also thought he still got his money
He's on the suspended list
And I don’t believe he’s getting paid.
I could be wrong.

I may have misunderstood the story about him signing the contract this week
The Marlins and Oviedo — the pitcher formerly known as Leo Nuñez — agreed on Tuesday to a contract that would pay him $6 million next season.
But Oviedo will never see a nickel of it if he is unable to leave the Dominican Republic, return to the United States and play baseball. Oviedo continues to work through the legal hurdles to allow for his return, perhaps in time for Opening Day in April.
and
Oviedo was forced to return to the Dominican late last September after it was discovered he had been playing under an assumed name — Nuñez — throughout his professional career.
The Marlins placed Oviedo on their restricted list.
Oviedo, like three other Marlins players, was eligible for salary arbitration, and Major League Baseball instructed the Marlins to treat him no differently than any of the others.
But the team won’t pay Oviedo until he’s activated from the restricted list, and they won’t do that until he’s back in the United States throwing a baseball.
http://www.miamiherald.com/2012/01/18/2594439/juan-carlos-oviedo-formerly-leo.html
I took that to mean that he got paid last year but won’t get paid this year unless he returns, but now I see that it could mean that he hasn’t gotten paid since being placed on the restricted list.
When/if he returns, does he get the money he was due when he was on the restricted list?

I forget, did he lie about his age or just his name?
Just an assumed name might not void the contract.

I am deeply disappointed in our legal system if signing a contract with a false name doesn't make it void.
But, yes, he lied about his age as well. It was the reason for lying about his age – he assumed the identity of a younger friend.
As one of the (many) lawyers on staff here at RR...
…I note that you want that contract to be “voidable” not “void.” That way, the Tribe could hold him to it if they wanted to. (They presumably didn’t commit any fraud, so why should they automatically lose the benefit of their contract).
If a lawsuit were actually filed over this, they would need/want to establish is that his age was a material term of the deal. If it isn’t in the written contract they might not be able to do that. On the other hand, if he can’t get into the USA to play baseball games (for a reason that is entirely his fault) he would probably be found to have breached the contract, and they wouldn’t have to pay him for that reason. (Also, there are most certainly MLB rules dealing with this situation, but you didn’t mention that… just “our legal system”).

Without boring you too much
Most contracts aren’t voidable unless there’s a “material” breach.
Lying about your name would be fraud and therefore a breach, but it probably would not be material because the Indians were paying him to pitch, and his name doesn’t affect how good he is at pitching.
However, lying about his age is probably both fraudulent and material, because it would affect how good he is at pitching, and the Indians aren’t getting what they paid for.
And if he can’t play in the US, that’d also probably be material for similar reasons.
You sound somewhat less drunk than kcemigre
Although I appreciate both your responses and found both to be informative and interesting!
I'm pretty sure that players on the restricted list don't get paid, period
I think that is in the standard player contract under the CBA.

certainly seems like you could void at least that much of it and anything going forward, not like u can get back what’s already paid

Can we observe just one moment of sadness over this...

I keep trying to find a way to make a "Carmona Not Glue" joke.
But would anyone get the reference?
Jon Heyman had a great joke on this...
Indians are trading Fausto Carmona to Marlins for Leo Nunez and a player to be named later.

So Jose Canseco gets credited/blamed for blowing the lid off a longtime issue
But didn’t Danny Almonte unintentionally do the same thing?
I can't blame him for upgrading from Roberto Hernandez Heredia to Fausto Carmona
I think I would upgrade to Rex Hasselhoff or Bruce Facesmash.

So apparently the story is
Roberto Hernandez-Heredia was paying off the real Fausto Carmona to keep quiet. Carmona asked for a raise, and Heredia said no, so Carmona busted him.
Wouldn’t Carmona also be subject to criminal penalties though?
Relive Royals History at royalsretro.blogspot.com
it'd probably a lot less severe for the real Fausto
He could probably be charged with Conspiracy and Blackmail. But it’d be a pretty impossible case for the US government to pursue and I doubt the DR is really motivated to pursue charges.
So There Really
